Anthem DUI

Anthem DUI

The new tough laws for a DUI in Arizona are considered to be among the toughest in the country and working with an Anthem DUI attorney can be the difference between your dom and a life totally thrown into chaos because of one bad choice. An Anthem DUI attorney is a legal professional who is trained in the DUI laws in Arizona that will protect your rights while defending your case before the court system in Arizona. Arizona now has mandatory DUI penalties that include mandatory jail time for even the first DUI offense. If you are a multiple time offender, life will get increasingly more and more difficult with each conviction. There are many cases where field sobriety tests have been taken under less than excellent conditions and people have even had to face DUI charges if the officer simply suspects that you are under the influence and other evidence is in existence. If you are stopped for a DUI, remain silent and contact an Enholm Law, PLLC Anthem DUI attorney for a initial case evaluation to help protect your rights and defend your case.

What Is Under The Influence

Arizona Revised Statute (ARS) 28-1381 defines any driver with a blood alcohol level of 0.05 or less is deemed be sober under Arizona law. Any driver with a blood alcohol level between 0.05 and 0.08 is technically defined as not under the influence. It is important to note that if other competent evidence is available, you could be facing criminal charges even when your blood alcohol is 0.08 or less. This is a grey area and having a tough Phoenix DUI Attorney on your side is critical to your case. A driver that has a blood alcohol level over 0.08 is considered to be under the influence by Arizona law. Any person with a blood alcohol level of 0.15 or greater can be charged with being under “extreme influence”. Penalties for “extreme influence” are much greater. Under the influence is defined as including any drug, any liquor, any combination of drugs and liquor, any vapor releasing substance that is toxic and finally any vapor releasing substances or drugs if you appear to be impaired by the smallest amount.
